These Terms & Conditions (“Terms”) govern your use of www.ezcomtrust.com (the “Site”) and your communications with EZ Computer Trust (“EZ Comtrust,” “we,” “us,” or “our”). By using the Site, submitting a form, or opting in to our communications, you agree to these Terms.

1. Use of the Site

The Site and its content are provided for general information about our managed IT and technology services for nursing homes and long-term care facilities. You agree to use the Site lawfully and not to interfere with its operation or security.

2. Services

Descriptions of services on the Site are informational and do not constitute a binding offer. Specific services, pricing, and service levels are defined in a separate written agreement between EZ Comtrust and the client.

3. SMS / Text Messaging Program Terms (A2P 10DLC)

EZ Comtrust offers informational and customer-care text messaging (the “SMS Program”) to people who opt in.

• Program description. When you opt in, you will receive text messages (SMS/MMS) from EZ Comtrust related to your inquiry or account, such as responses to your assessment request, scheduling and appointment coordination, service and support updates, and account notifications.
• Opt-in. You consent to receive text messages when you provide your mobile phone number to us through the Site (for example, in our assessment request form), by phone, or in writing, and agree to be contacted by text. Consent to receive text messages is not a condition of purchasing any goods or services.
• Message frequency. Message frequency varies based on your interaction with us.
• Message and data rates may apply. Standard rates from your mobile carrier may apply to messages you send and receive.
• Opting out. You can cancel the SMS Program at any time by replying STOP to any message. After you send STOP, we will send a final message confirming that you have been unsubscribed, and you will receive no further messages. To rejoin, opt in again as described above.
• Help. Reply HELP to any message for assistance, or contact us at emile@ezcomtrust.com or 347-893-6504.
• Carriers. Mobile carriers are not liable for delayed or undelivered messages.
• Privacy. Mobile opt-in data and consent will not be shared with or sold to third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for details on how we handle your information.

4. Intellectual property

The Site, including its text, design, graphics, and logos, is owned by EZ Comtrust or its licensors. Third-party names and logos shown on the Site are the property of their respective owners. You may not reproduce Site content without permission.

5. Disclaimers

The Site is provided “as is” without warranties of any kind. While we work hard to keep information accurate and current, we make no guarantee that Site content is error-free. Nothing on the Site constitutes legal or compliance advice.

6. Limitation of liability

To the fullest extent permitted by law, EZ Comtrust will not be liable for indirect, incidental, or consequential damages arising from your use of the Site. Liability related to contracted services is governed by the applicable service agreement.

7. Changes to these Terms

We may update these Terms from time to time. The effective date above reflects the latest revision. Continued use of the Site after changes constitutes acceptance.

8. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
